Terms and Conditions

Welcome to Crunch! These Terms and Conditions ("Terms") govern your use of the Crunch mobile application ("App"), owned and operated by UAB Crunch Health ("Company," "we," "our," or "us"). By using this App, you agree to comply with these Terms.

1. Acceptance of Terms

By using Crunch, you certify that you have read, understood, and agreed to these Terms. If you do not agree, you must discontinue use of the App immediately.

2. Privacy Policy

Crunch collects and stores user dietary preferences, including a list of ingredients a user cannot consume and dietary choices, as well as photographs you upload of product labels (collectively “User Data”). This data is stored securely on our servers in Vilnius, Lithuania. Please refer to our Privacy Policy for details on how we manage your data, including the retention of uploaded images, any automated processing, and how you may request deletion.

3. Age Restrictions

• Users must be at least  20 years old to access alcohol‑related content within the App. If a product contains alcohol, users under 20 will not see the products information.
  
  

• Users of any age can create an account, subject to applicable laws.
  
  

4. User Accounts

• Users may create an account using social‑media login and passkey.
  
  

• Users are responsible for maintaining account security and ensuring their login credentials remain confidential.
  
  

• Users must provide accurate and updated information during registration and maintain its accuracy over time.
  
  

• Accounts may be deleted by emailing info@crunchapp.co.
  
  

• Crunch reserves the right to terminate accounts at its discretion for violations of these Terms or any activity that could compromise the security or functionality of the App.
  
  

5. User‑Submitted Images

Crunch allows you to upload photographs of product ingredient lists, front‑of‑pack labels, and nutrition‑facts panels (“Images”).

(a) Ownership & Permissions. You confirm you have the right to upload each Image and that it does not infringe any third‑party intellectual‑property or privacy rights.
(b) Licence to Crunch. By uploading an image you grant UAB Crunch Health a worldwide, royalty‑free, non‑exclusive, sublicensable licence to host, copy, analyse, translate, and display the Image and any data derived from it for the purposes of operating and improving the App and our services, including enhancement of ingredient‑ and label‑recognition technology.
(c) Prohibited Content. Images must not contain illicit, defamatory, or personal data identifying an individual (e.g., faces, payment cards). Crunch may remove or block any Image at its sole discretion.

6. User Responsibilities

Users agree not to engage in unauthorized access or attempts to bypass security measures in the App.
Any actions that disrupt or interfere with the proper functioning of the App are strictly prohibited.
Users must not upload Images containing malware, hidden code, or content unrelated to product labelling.

7. Liability Disclaimer

Crunch provides recommendations only. Final consumption decisions are the responsibility of the user.
Crunch does not create or verify product information; it translates existing or slightly modified data. Product details may be inaccurate or insufficient, and we assume no liability for errors or omissions.
Because photos are supplied by users and may be blurry, poorly lit, cropped, or otherwise inaccurate, Crunch assumes no liability for errors arising from the processing of such Images.
The App is not a substitute for medical or professional dietary advice.

8. Third‑Party Content & Links

The App may contain links to third‑party retailers where users can purchase products. Crunch is not responsible for the accuracy, availability, or reliability of these third‑party websites. Users acknowledge that third‑party links are accessed at their own risk and that Crunch does not endorse or assume liability for external content.

9. Intellectual Property & Content Usage

All content within Crunch, including translations, branding, and proprietary algorithms, is the exclusive property of UAB Crunch Health. Users may not scrape, extract, or redistribute any data from the App.
By submitting feedback, Images, or other content, users grant Crunch the licence described in Clause 5 to use, modify, and display such content publicly.
Users are prohibited from submitting any content that is unlawful, offensive, misleading, or otherwise violates ethical standards.

10. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of Lithuania.
Any disputes shall be resolved through binding arbitration in Lithuania, unless otherwise required by law.
Users waive the right to participate in class‑action lawsuits or collective legal claims against Crunch.

11. Modifications to the Service

Crunch reserves the right to modify, update, or discontinue any aspect of the App—including functionalities that process user‑uploaded Images—at any time, without prior notice. Users acknowledge that continued use of the App after modifications implies acceptance of the changes.

12. Termination of Services

Crunch may suspend or terminate a user's access at its sole discretion for any violations of these Terms, legal requirements, or actions deemed harmful to the App.

13. Disclaimer of Warranties

The App is provided on an "as is" basis without warranties of any kind, including warranties that uploaded Images will be processed without error. Crunch makes no guarantees regarding the accuracy, completeness, or suitability of the information presented.

14. Limitation of Liability

Crunch's liability is limited to the extent permitted by law. In no event shall Crunch’s total liability exceed the total amount, if any, paid by the user to access the App within the past year.

15. Communications and Feedback

With your consent, you allow us to be contacted by UAB Crunch Health via email or by phone for the purpose of obtaining feedback on our product. Such communications may include surveys, product reviews, and other inquiries aimed at improving our services. If you do not wish to receive these communications, you may opt‑out at any time by contacting us at info@crunchapp.co.
